Physical Exertion Attorneys

Physical Exertion

There's no question that nursing is a strenuous profession, and physical exertion can place a nurse at risk for serious, even deadly injury. But how does physical exertion put nurses at risk, and what can injured nurses do to get the compensation they deserve?

"Physical exertion" refers to the ways in which a nurse exerts herself physically at work. Physical exertion can include lifting, pulling, reaching, running, squatting, and other highly physical activities involved in a nurse's expected duties. Because of the ever-changing nature of nursing and decreasing staffing levels, a nurse could be expected to run quickly down a hall one day and get on her hands and knees looking for a book another. The very range of expected physical exertion in nursing puts nurses at risk for strains, sprains, bruises, fatigue, broken bones, even more serious injuries such as slips and falls, traumatic brain injuries, and death. Studies have found that a nurse's perception of her job as physically strenuous is directly correlated by her injury risk.

When a nurse is injured, she might not always find support from her employer. Her insurance company may blow off her injuries even if they are acute or chronic, and she may find her workplace unaccommodating of her physical limitations. While physical exertion certainly is part of the job in many cases, in others the employer owes the nurse assistance, better training, additional equipment, and other accommodations to make the workplace more accessible and safe. However, employers who are strapped for time and cash can overlook these accommodations – and their negligence can result in deadly injuries to their staff.

Luckily, nurses have rights under the law. In cases in which an employer's unreasonable expectations or failure to accommodate or provide for a safe workplace cause injury, the nurse can seek recourse via workers compensation or the civil courts, seeking monetary damages to cover costs of care, ongoing treatments and hospitalizations, even vocational rehabilitation and/or psychological counseling. It is recommended that a nurse in this situation seek a qualified, reputable nursing work injury attorney with physical exertion and nursing injury experience to represent him or her in these cases.
